Схема заволодіння землею за підробленими дублікатами заповітів на Вінниччині — викрито організовану групу на чолі з адвокатом
У межах документування схеми незаконного заволодіння землями сільгосппризначення на території Вінниччини правоохоронці встановили, що її організував адвокат, який залучив двох посадових осіб сільської ради Хмільницького району.
За його вказівками староста і діловод одного зі старостинських округів сільради вносили недостовірні відомості в офіційну документацію. А саме — журнали реєстрації нотаріальних дій про видачу заповітів від імені померлих, довідки про місце реєстрації на день смерті, спадкового реєстру, а також підробляли дублікати заповітів.
Упродовж 2022–2024 років право власності на 19 невитребуваних земельних паїв померлих незаконно набули 11 людей, в тому числі діловод сільської ради. Загальна площа сільгоспугідь становить майже 50 га оціночною вартістю понад 4 млн гривень.
Адвоката затримано в порядку ст. 615 КПК України та за клопотанням прокуратури обрано запобіжний захід у виді тримання під вартою з можливістю внесення застави.
Дії учасників організованої групи кваліфіковано за статтями 190, 209, 358, 362, 364, 366 КК України.
Інших протиправних власників викрито раніше. Досудове розслідування щодо них завершено, обвинувальні акти передано до суду. Стосовно двох вже ухвалено обвинувальні вироки.
В рамках слідства на всі земельні ділянки накладено арешт.
За процесуального керівництва Вінницької обласної прокуратури досудове розслідування здійснюється слідчим управлінням ГУНП у Вінницькій області за оперативного супроводу Управління карного розшуку поліції та Управління СБУ у Вінницькій області.

Land acquisition scheme based on forged duplicate wills in Vinnytsia region — organized group led by lawyer exposed
As part of documenting a scheme for illegal seizure of agricultural lands in the Vinnytsia region, law enforcement officers established that it was organized by a lawyer who involved two officials of the village council of the Khmilnyk district.
On his instructions, the village headman and clerk of one of the village council's districts entered false information into official documentation. Namely, the registers of registration of notarial acts on the issuance of wills on behalf of the deceased, certificates of the place of registration on the day of death, the inheritance register, and also forged duplicates of wills.
During 2022–2024, 11 persons, including the village council clerk, illegally acquired ownership of 19 unclaimed land shares of deceased persons. The total area of the farmland is almost 50 hectares with an estimated value of over UAH 4 million.
The lawyer was detained pursuant to Article 615 of the Criminal Procedure Code of Ukraine and a motion has been filed with the court to impose a preventive measure in the form of detention.
The actions of the members of the organized group were qualified under Articles 190, 209, 358, 362, 364, 366 of the Criminal Code of Ukraine.
Other illegal owners were exposed earlier. The pre-trial investigation against them has been completed, the indictments have been submitted to the court. Convictions have already been passed against two of them.
As part of the investigation, all land plots were seized.
Under the procedural supervision of the Vinnytsia Region Prosecutor's Office, the pre-trial investigation is carried out by the Investigative Department of the Main Police Department in Vinnytsia Region with operational support of the Criminal Investigation Department of the Police and the SSU Department in Vinnytsia Region.
