Прокуратура повернула з приватної власності гідротехнічні споруди на Рівненщині вартістю понад 2,3 млрд грн
На виконання рішень судів припинено право володіння приватного товариства на комплекс гідротехнічних споруд – захисних дамб загальною площею понад 170 тис кв м, розташованих на території Вараського району Рівненської області.
Прокурори встановили, що гідротехнічні споруди, вартість яких перевищує 2,3 млрд грн, перебували на балансі одного із державних підприємств. Втім, у 2016 році внаслідок незаконної державної реєстрації прав на нерухоме майно ці споруди перейшли у приватну власність. У подальшому захисні дамби внесли до статутного капіталу приватної юридичної особи та перепродали. Таким чином майно опинилось у власності однієї зі столичних агрофірм.
Реагуючи на ці порушення, Вараська окружна прокуратура звернулась до суду. Спочатку Господарський суд Рівненської області, а згодом і Північно-західний апеляційний господарський суд підтримали позицію прокуратури та задовольнили позов в інтересах держави в особі Регіонального відділення Фонду державного майна України по Київській, Черкаській та Чернігівській областях до ТОВ.

The Prosecutor's Office returned hydraulic structures in the Rivne region worth more than UAH 2.3 billion from private ownership
To enforce court decisions, the right of ownership of a private company to a complex of hydraulic structures of – protective dams with a total area of more than 170,000 square meters, located on the territory of the Varash district of the Rivne region, has been terminated.
Prosecutors established that hydraulic structures, the value of which exceeds UAH 2.3 billion, were on the balance sheet of one of the state-owned enterprises. However, in 2016, as a result of illegal state registration of rights to immovable property, these buildings became private property. In the future, the protective dams were added to the authorized capital of a private legal entity and resold. In this way, the property was owned by one of the capital's agricultural companies.
Responding to these violations, the Varash District Prosecutor's Office appealed to the court. First, the Commercial Court of the Rivne Region, and later the North-Western Commercial Court of Appeal, upheld the position of the Prosecutor's Office and granted the lawsuit in the interests of the state in the person of the Regional Branch of the State Property Fund of Ukraine in the Kyiv, Cherkasy and Chernihiv Regions to LLC.
