Незаконно видобули 8 тис тонн піску з річки Десна на Київщині – судитимуть трьох працівників спеціалізованого підприємства
Прокурори Спеціалізованої екологічної прокуратури Офісу Генерального прокурора скерували до суду обвинувальний акт стосовно трьох працівників підприємства за фактом незаконного видобування корисних копалин місцевого значення у великому розмірі (ч. 4 ст. 240 КК України).
Підприємство, яке займається видобуванням піску та має у власності спеціалізовану техніку, надаючи послуги іншому підприємству, протягом 2023 року видобувало пісок з річки Десна у Київській області в межах Осещинського та Деснянського-верхнього родовищ.
Встановлено, що в серпні 2023 року обвинувачені незаконно видобули з річки Десна 8 тис тон піску за межами Деснянського-верхнього родовища, на підставі складених актів завантажили на баржі та перемістили до місця зберігання у м. Києві.
Такими діями завдано шкоду довкіллю на суму понад 6 млн грн.
Під час досудового розслідування представники потерпілого у межах кримінального провадження заявили цивільний позов про стягнення завданої довкіллю шкоди. Прокурори з метою забезпечення цивільного позову наклали арешт на майно обвинувачених та підприємства, яке виконувало роботи.
Досудове розслідування у кримінальному провадженні здійснювало Головне слідче управління Національної поліції України за оперативного супроводу Головного управління з протидії системним загрозам управління державою ДЗНД СБУ.

8,000 tons of sand were illegally extracted from the Desna River in the Kyiv region – three employees of a specialized enterprise will be tried
Prosecutors of the Specialized Environmental Prosecutor's Office of the Prosecutor General's Office sent an indictment to the court against three employees of the enterprise for the illegal extraction of local minerals on a large scale (part 4 of Art 240 of the Criminal Code of Ukraine).
An enterprise engaged in sand mining and owns specialized equipment, providing services to another enterprise, during 2023 extracted sand from the Desna River in the Kyiv region within the Oseshchyna and Desna upper deposits.
It was established that in August 2023, the defendants illegally extracted 8 thousand tons of sand from the Desna River outside the Desna Upper deposit, loaded it onto a barge based on the prepared documents, and moved it to a storage location in Kyiv.
These actions caused environmental damage worth over UAH 6 million.
During the pre-trial investigation, the victim's representatives filed a civil lawsuit within the framework of criminal proceedings to recover environmental damage. In order to secure the civil lawsuit, prosecutors seized the property of the defendants and the company that performed the works.
The pre-trial investigation in the criminal proceedings was carried out by the Main Investigation Department of the National Police of Ukraine with operational support of the Main Department for Counteracting Systemic Threats to State Governance of the Department for the Protection of National Statehood of the SSU.
